How do we process your personal data?

Your personal data are processed in accordance with the conditions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter also referred to as GDPR).

We also assure you that your personal data will be processed in a transparent and fair manner and that we will make every effort to ensure that it is treated with due care and responsibility.

In order to ensure the fairness and transparency of the processing of personal data provided to us, in accordance with the obligation arising from Article 13 of the GDPR, we would like to provide you with the following information:

Who is the administrator of your personal data?

The controller of the personal data you provide, i.e. the entity that will decide on the method and purposes of their processing, is: ERES Partner Sp. z o. o. Sp. k. with its registered office in Kraków, at ul. Wileńska 5 lok. 18, 31-413 Kraków, NIP: 9442266886 (hereinafter also referred to as the Controller). You can contact us by sending correspondence to ul. Wileńska 5 lok. 18, 31-413 Kraków or by email at: kontakt@eres-partner.pl

What is the purpose and legal basis for processing your personal data?

The legal basis for processing personal data depends directly on the purpose for which the data is collected and used. ERES Partner Sp. z o. o. Sp. k. processes your personal data in particular for the following purposes:

  1. in order to conclude and perform the contract between us – in particular the cooperation agreement with the Controller for services provided by Uber, Bolt or FreeNow in Poland (legal basis: Article 6 paragraph 1 letter b) of the GDPR);
  2. on the basis of your consent to the extent to which the consent was granted, including marketing purposes (legal basis: Article 6 paragraph 1 letter a) of the GDPR);
  3. in order to perform the legal obligations incumbent on ERES Partner Sp. z o. o. Sp. k., including making settlements, issuing invoices and accounting documents (legal basis: Article 6 paragraph 1 letter c) of the GDPR);
  4. pursuant to Article 6(1)(f) of the GDPR, i.e. based on the legitimate interest of ERES Partner Sp. z o. o. Sp. k., allowing, among other things, to pursue any claims arising from contracts and defend against any claims;
  5. to handle your inquiries and complaints, including resolving technical issues (Article 6, Section 1, paragraph c of the GDPR – compliance with our legal obligations);
  6. in order to analyse the activity of website users and their preferences in order to improve the functionalities and services provided, as well as to adapt the content displayed to users, based on the User’s consent (Article 6, paragraph 1, letter a) of the GDPR);

What personal data do we process?

In order to conclude and execute a cooperation agreement with the Controller for services provided by Uber, Bolt or FreeNow, the Controller may process your personal data to the following extent:

  • first name and last name,
  • PESEL number,
  • document numbers/series (ID cards, passports, driving licenses, residence cards, etc.),
  • information about criminal records,
  • information about any other sources of income,
  • email addresses,
  • telephone numbers,
  • documents related to claims (e.g. letters from bailiffs, courts, police),
  • documents with vehicles of cooperating persons,
  • bank account numbers,
  • information about owned cars.

How long will personal data be stored?

The period for which your personal data is processed depends on the purpose for which it was collected and the applicable law. In particular, we process data related to:

  • conclusion and performance of the contract – for the time necessary for the proper performance of the contract and then until the expiry of the limitation period for any claims;
  • consent to their processing – until you withdraw your consent;
  • issuing accounting documents – for the period required by law;
  • pursuing or defending claims, especially in the event of a court dispute – until the final conclusion of the proceedings and the expiry of the limitation periods specified by law.

Do you have to give us your personal information?

Providing personal data for the purpose of concluding and properly performing the obligations arising from the contract is voluntary, but necessary to establish cooperation in the scope of services offered by the Controller. Therefore, failure to provide data to the extent required by the Controller may result in the inability to commence cooperation with the Controller. Therefore, if you fail to provide the data required by the Controller to commence cooperation, you will not be able to perform orders for Uber, Bolt, or FreeNow.

What rights do you have regarding the personal data provided to you?

You have the right to request access to your data from the Administrator and receive a copy thereof, the right to rectify (amend) your data, the right to erase your data, the right to restrict data processing, the right to object to data processing, the right to data portability, and the right to lodge a complaint with a supervisory authority. To facilitate the exercise of your rights, we encourage you to contact us electronically at: kontakt@eres-partner.pl

Can you withdraw your consent to the processing of personal data?

If your personal data is processed on the basis of your consent, you have the right to withdraw your consent to the processing of your personal data at any time, but the withdrawal of consent does not affect the lawfulness of the processing based on your consent before its withdrawal.

Who may be the recipient of your personal data?

The Administrator, except as otherwise provided in applicable law, will not share your personal data with third parties. However, in connection with the performance of the contract, we may transfer your personal data to our partners – contractors, in particular IT service providers, law firms, and accounting firms. Such entities process data based on an agreement with us and only in accordance with our instructions. Furthermore, your data will not be transferred to a third country or international organization.
